Client was in a hurry to get to work. It was alleged by an elderly couple (who were driving in the passing lane), that client hit them while he attempted to merge in front of them. When they called police, they alleged that client hit them so hard with his car that their vehicle shook and almost swerved out of control.

It should be noted that there was ZERO structural damage to their vehicle, nor our client’s vehicle. The only evidence that an impact occurred was a very small patch of paint on their bumper matching the color of client’s vehicle. But who would believe that an elderly couple would exaggerate anything?

Despite no evidence of such an impact, police arrested client on reckless driving and failure to perform duties of a driver. Defense hired an engineer that did an accident reconstruction report. This report made it obvious that the complaining couple could not have been honest about the severity of the impact.

After receiving our expert witness report (and the complaining couple refusing to come to court after defense set the case for trial!) the prosecutor had to dismiss the case.
